Subject:Re: A New Hammond Clone Arriving

Hi Goff and All,

Sure , it can be a trademark issue in Japan, but it will so only in each country where Tokai has been filed with local Patent Agency, as that should be only analyzed upon a country basis, case by case.

It resembles what it happens in the net where www.Acme.CD if hasn't registered under the law of Congo, Democratic republic of the (former Zaire) then can be registered by anyone wishing to do it so rather than being a right of 'ACME' global site.

Don't know the intricacies of the trademark issue but wonder if they are absolutely different firms otherwise I thought is a Brazilian 'Nissei' name (Japanese descendant)

In turn Brazil is a country with the largest community of Japanese descendant out of the Isles along with 'Nissei' from Brazil are the largest foreign community of Japanese not born there but living in Japan.

Guesss that the biggest part of the sales pie should be done in Brazil rather than overseas.

BTW, http://www.tokai.co.jp/ is a rubber manufacturer so guess that should be a more complex trademark issue there than all around the globe.

Hope this helps to clarify it from a primer view.

It can be purchased at major music dealers, but guess isn't far from the XK-1 average U$ 2,500 not too bad for a market niche.

As a salesman told me, a Hammond keyboard is the kind of product (if assuming female) 'looking more than expected for a 'boy friend' that choose it'. In other terms it will be in stock longer than the average Strato or Yammy grand piano controller.

Best,

Rafael

I've been following this thread.

I think the reason the guys in Brazil are making clones is
because their tax system makes it prohibitive to import affordable
clones from elsewhere.

Same thing the Italians have done with their clones.

If they sell some in the US good for them but perhaps its for their domestic market that these Tokai's exist.

And it's funny how we'd associate the name Tokai with a Japanese company thinking it to be a Japanese name as Tokai Japan makes great Strat and Tele, etc, copies as well as a slew of guitar pedal effects that at this day have become collector's items..

I'm curious how selling a musical instrument with the name Tokai is going to cause any legal prpblems for this keyboard company..
