It is surprising how easy it is to circumvent patents by making a few
modifications to a design. Even if the original patents were still in
effect, it looks like there are enough differences between his design
and the original to negate infringment claims.
An friend of mine invented the key fob. Yes, it made him VERY rich!
It took him six weeks to invent the one that we've all seen, but he
(and 6 other engineers) spent another 18 months developing and
patenting numerous variations to make sure that nobody was able to
make a slight modification and market it on his own. So far, his plan
has worked well.
