I can't be sure, but it would seem that yes, there would be a copyright infringement, if not some theft of intellectual property. Without proper licensing, there would be some problems. Practically every drum loop cd you purchase (as well as sampled synths, etc) comes with warning that no commercial value may be derived from the use of those samples without express written consent blahblahblah.
